In 2003, ExxonMobil and fellow corporate “amici” filed a brief in support of Nike in a free speech case before the Supreme Court called Nike v. Kasky. The case centered around media reports about Nike using sweatshop labor and Nike’s assertions that its labor practices were fair and equitable. A California man named Mark Kasky said that assertion was untrue and that Nike’s false marketing of its labor practices violated California’s consumer fraud laws. Nike argued that it had a right to defend itself in public and that its speech in that regard should be given a wide berth. Exxon and co supported that argument and said it should apply to any issue of public concern that corporations weighed in on, including “global warming, for example.”
